Pursuant to Texas Rule of Appellate Procedure 59.1, after granting the petition for review and without hearing
oral argument, the Court reverses the court of appeals' judgment and remands the case to that court.

The issue presented is whether an employee of a governmental unit may take an interlocutory
appeal from an order denying his motion to dismiss based on section 101.106(e) of the Texas Civil
Practice and Remedies Code. We hold that he can and reverse the judgment of the court of appeals.
